Terms of Service

These Terms of Service ("Terms") govern your use of HatchDay, an egg-incubation tracking application operated by VajgrtLabs ("we," "us," or "our"), available at hatchdayapp.com. By creating an account or using HatchDay, you agree to these Terms. If you do not agree, do not use the service.

1. Description of the Service

HatchDay is a progressive web application that helps poultry keepers, homesteaders, breeders, and hobbyists plan, track, and learn from egg-incubation hatches. Features include:

• Batch creation and tracking for dozens of bird species, with species-specific incubation parameters (temperature, humidity, turning, lockdown, and expected hatch timing).
• Temperature and humidity logging (charts are included with Pro plans).
• Candling checklists, task reminders, and notes.
• Post-hatch care guidance, including brooder setup, week-by-week brooding, health and first-aid information, and guidance on moving birds outside.
• Data export (CSV) and cross-device sync are included on every plan, free and paid.
• Offline records: create and edit batches, log temperature, humidity, candling, and notes, and view your records without a connection. Changes save on your device and back up automatically when a connection returns. Attaching a candling photo, signing in or up, subscribing, and resetting a password require a connection.

An account is required to use HatchDay. Your records are stored on your device and backed up to our servers when a connection is available, so backed-up records stay available and sync across your devices. The app shows the backup state and does not mark a change as backed up until the server confirms it.

2. Eligibility

You must be at least 13 years old to use HatchDay. If you are under the age of majority in your jurisdiction, you may use the service only with the consent and supervision of a parent or legal guardian, who agrees to these Terms on your behalf.

3. Accounts and Your Responsibilities

• You must provide a valid email address and create a password to register. You are responsible for keeping your login credentials confidential.
• You are responsible for all activity that occurs under your account. Notify us promptly at [email protected] if you suspect unauthorized access.
• Each paid subscription may be used on up to 3 devices. We may ask you to remove a device before adding another once the limit is reached.
• You agree to provide accurate information and to keep your account details up to date.

4. Plans, Free Trial, and Billing

HatchDay offers the following plans (prices in USD):

• Free — 2 active batches with logging and 2 incubator profiles, plus free access to care articles, the Stats pages, and the full species library.
• Free full-Pro trial — new accounts receive 7 days of full Pro access at no charge. No payment method is required to start a trial.
• Pro Monthly — $7/month, billed monthly.
• Pro 6-Month — $35 every 6 months, billed semi-annually.
• Pro Yearly — $56/year, billed annually.

Pro plans include unlimited active batches and incubator profiles, batch temperature and weight charts, candling photos, polished PDF reports, calendar reminders (.ics) and email milestone reminders, the backwards hatch planner, chick orders, voice logging, the breeder pack (pens, bird registry and pedigrees, show records, and the sales ledger), interactive care automation (hatch-date checklists and brooder reminders), and the Hutch & Hen handoff. The Stats pages — hatch rates and fertility analytics — are included on every plan, free and paid; only the per-batch charts are Pro. The species library, care articles, CSV export, full backup download, and cross-device sync are the same on every plan, free and paid.

• Payments are processed securely by Stripe. We never see or store your full card number — see our Privacy Policy.
• Subscriptions renew automatically until cancelled. By subscribing, you authorize Stripe to charge your payment method on each renewal date.
• If you purchase a Pro plan, your paid billing period starts immediately — the free trial does not stack onto or extend a paid subscription.
• Prices may change in the future. If they do, we will notify you in advance and any change will apply from your next renewal — never retroactively.
• Taxes may apply depending on your location and will be calculated at checkout.

5. Cancellation

• You can cancel a monthly, 6-month, or yearly subscription at any time using the self-serve Cancel Pro button in the app's subscription settings. No need to contact support.
• Cancellation takes effect at the end of your current billing period. You keep full Pro access until the paid time runs out; it is not cut off early.
• Account deletion is different: if you delete your account (Settings → Account → Delete account), any subscription is cancelled that same day instead of at the end of the billing period, and your account and data are deleted as described in the Privacy Policy (payment records are kept without your email attached, as tax and accounting law requires).
• Our refund terms are described in the Refund Policy.

6. Acceptable Use

You agree not to:

• Use HatchDay for any unlawful purpose or in violation of any applicable law or regulation.
• Attempt to gain unauthorized access to our systems, other users' accounts, or our infrastructure.
• Reverse-engineer, scrape, or copy the service in bulk, or interfere with its normal operation.
• Share your account credentials to circumvent the device limit or plan restrictions.
• Upload content that is unlawful, abusive, or infringes the rights of others.

We may suspend or terminate accounts that violate these Terms, with or without notice, particularly where necessary to protect the service or other users.

7. Educational Content Disclaimer

• Hatch timing, temperature, and humidity figures are research-informed estimates. Actual results vary with equipment, egg handling, and conditions. You hatch and raise birds at your own risk.
• Health and first-aid content describes commonly used home-care practices. We do not prescribe medication. If a bird is seriously ill or suffering, consult a poultry veterinarian.
• We make no guarantee of hatch rates, chick survival, or any particular outcome.

8. Intellectual Property

The HatchDay application, including its design, text, graphics, species data compilations, care content, and software, is owned by VajgrtLabs and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use HatchDay for personal, non-commercial purposes in accordance with these Terms. You may not copy, redistribute, or create derivative works from our content without written permission. Your data — your batches, logs, notes, and photos metadata — remains yours.

9. Limitation of Liability

To the maximum extent permitted by law:

• HatchDay is provided "as is" and "as available" without warranties of any kind, express or implied.
• VajgrtLabs is not liable for any loss of eggs, chicks, birds, income, or data, or for any indirect, incidental, or consequential damages arising from your use of the service — including reliance on incubation or care guidance.
• Our total liability for any claim related to the service will not exceed the amount you paid us in the 12 months preceding the claim (or $10 if you paid nothing).

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless VajgrtLabs from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the service or violation of these Terms.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, for material changes, notify you in the app or by email. Continued use of HatchDay after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of Illinois, USA, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in Illinois, and you consent to their jurisdiction.
